In March, the U.S. Bankruptcy Court for the Southern District of New York confirmed Endo’s Chapter 11 plan of reorganisation, enabling Endo to successfully complete its financial restructuring. Under this arrangement, substantially all of Endo’s assets are being sold to a new entity, Endo, Inc.
A multi-disciplinary team of lawyers based in the firm’s Dublin office acted as special foreign counsel to the OCC in respect of the Chapter 11 restructuring proceedings in New York and as Irish counsel in respect of the Irish Scheme of Arrangement. This team was led by Dispute Resolution & Insolvency Partners Robin McDonnell and Karole Cuddihy, Finance Partner Alma O’Sullivan, along with Tax Partner William Fogarty. The firm’s role as special foreign counsel was confirmed by order of the U.S. Bankruptcy Court in February 2023. Cooley LLP acted as lead counsel to the OCC.
Robin McDonnell, head of the firm’s Irish Dispute Resolution & Insolvency team, commented: “We are delighted to have supported the OCC on the successful confirmation of this Irish Scheme of Arrangement.
