Maples Group Advises the Official Committee of Opioid Claimants in Endo’s US$6 Billion Irish Scheme of Arrangement

Maples and Calder (Ireland) LLP, the Maples Group’s law firm in Ireland, is pleased to have been selected to advise the Official Committee of Opioid Claimants (the “OCC”) on Endo International plc’s (“Endo”) US$6 billion Irish Scheme of Arrangement.

In March, the U.S. Bankruptcy Court for the Southern District of New York confirmed Endo’s Chapter 11 plan of reorganisation, enabling Endo to successfully complete its financial restructuring. Under this arrangement, substantially all of Endo’s assets are being sold to a new entity, Endo, Inc.

A multi-disciplinary team of lawyers based in the firm’s Dublin office acted as special foreign counsel to the OCC in respect of the Chapter 11 restructuring proceedings in New York and as Irish counsel in respect of the Irish Scheme of Arrangement. This team was led by Dispute Resolution & Insolvency Partners Robin McDonnell and Karole Cuddihy, Finance Partner Alma O’Sullivan, along with Tax Partner William Fogarty. The firm’s role as special foreign counsel was confirmed by order of the U.S. Bankruptcy Court in February 2023. Cooley LLP acted as lead counsel to the OCC.

Robin McDonnell, head of the firm’s Irish Dispute Resolution & Insolvency team, commented: “We are delighted to have supported the OCC on the successful confirmation of this Irish Scheme of Arrangement. This highly complex transaction demonstrates our unparalleled, multi-disciplinary restructuring expertise”.

Maples and Calder has a market leading global Dispute Resolution & Insolvency practice and continues to act as counsel on a number of the largest and most complex litigation and global restructuring matters. Impressively, the practice was ranked as a top firm in Global Restructuring Review’s top 100 global restructuring and insolvency firms.

Our Irish Dispute Resolution & Insolvency team has been selected to advise a number of entities who are party to insolvency or restructuring proceedings including acting for aircraft lessor clients in the high-profile and complex restructuring of Norwegian Air through an Irish examinership. The team also recently acted as special foreign counsel to the Official Committee of Unsecured Creditors of Mallinckrodt plc in the Chapter 11 proceedings in the US and as Irish Counsel in the examinership proceedings in Ireland. We continue to act for the Joint Official Liquidators of Treasury Holdings and 15 related companies in one the largest and most complex compulsory liquidations in Ireland in recent years.
