Global Restructuring Review – Irish Practitioners Welcome Court-Approved Scheme Allowing Barclays to Sell German Arm

Contributing to an article published by Global Restructuring Review (GRR), Dublin-based Partner Robin McDonnell and Of Counsel Kathlene Burke welcomed a decision by the Irish High Court confirming the court’s jurisdiction in complex cross-border schemes of arrangement and clearing the way for regulatory approval for Austrian bank BAWAG to acquire Barclays’ German retail business, one month after the Irish court sanctioned a solvent scheme for the deal.
In the GRR article, titled ‘Irish practitioners welcome court-approved scheme allowing Barclays to sell German arm’, Robin and Kat noted that this is another important case demonstrating the flexible nature of Irish schemes of arrangement and how they continue to be recognised and enforced automatically in the EU following Endo International plc’s multi-jurisdictional restructuring last year.
The Maples Group advised the Official Committee of Opioid Claimants on Endo’s US$6 billion Irish Scheme of Arrangement. Led by Robin, the Dispute Resolution & Insolvency team in Dublin acted as special foreign counsel in respect of the Chapter 11 restructuring proceedings in New York and as Irish counsel in respect of the Irish Scheme of Arrangement.
