Materiality and Inducement in Cayman Islands Insurance Law

In a decision dated 28 October 2011, the Grand Court considered the circumstances in which an insurer under a policy governed by Cayman Islands law can escape liability even where coverage issues did not arise, and provided a useful reminder of the established common law principles of insurance law, applying long-standing English statute and jurisprudence.  In doing so, the Court has sent a clear message of certainty regarding construction of Cayman Islands insurance policies.
